The Corporate Director – Resources referred to the evidence given to the Cumbria Welfare Reform Commission by the third sector (Chaired by the Bishop of Carlisle) where concerns were raised that some suppliers to the County Council may not have been adhering to their duties and responsibilities to payment of the minimum wage which resulted in the Leader requesting a review with the results being reported to Cabinet.
The report provided information on the review undertaken to assess the extent to which the Council’s contracted providers of domiciliary care services were meeting statutory and contractual obligations to pay staff delivering such care the minimum wage. Whilst the review undertaken had found no evidence to substantiate the claims that staff were being paid less than the minimum wage (when travelling time was taken into account) the issue would be kept under review through contract management processes and some specific actions designed to ensure on-going compliance by the providers eg. Supplier briefing meetings, requiring providers to sign a declaration confirming they paid at least minimum wage, reviewing of contracts of providers failing to sign such a declaration with a view to termination and strengthening contract clauses and performance management arrangements.
The Leader confirmed that the Council took this matter very seriously and required its contractors to pay at least the minimum wage and to comply with the law. He advised that he would like to hear from anybody having evidence of potential malpractice taking place and confirmed that any information supplied would be treated as confidential and a persons anonymity would be respected if they wished to provide the information on that basis.
RESOLVED,that progress made on this review be noted and the next steps shown in section 4.9 of the report and set out above be approved.
