NB   The following is a summary of what constitutes a personal interest and a personal and prejudicial interest.  Please seek advice or refer to the Code of Conduct (paragraph 8) for full definitions.

 

Personal Interests

 

You have a personal interest if the issue being discussed in the meeting affects the well-being or finances of you, your family or your close associates more than most other people who live in the Electoral Division affected by the issue.

 

Personal interests are also things that relate to an interest you must register.

 

N.B. If the personal interest arises because of your membership of another public body, you only need to declare it if you intend to speak.

 

A personal interest should be declared as follows:

 

I have a personal interest in agenda item […] regarding the report on […] because I am […].

 

Personal and Prejudicial Interests

 

If you have a personal interest in a matter you will also have a prejudicial interest in that matter if the interest is one which a member of the public, with knowledge of the relevant facts, would reasonably regard as so significant that it is likely to prejudice your judgement of the public interest.  If you have a personal and prejudicial interest you must withdraw from the meeting room for that item, unless you are there to make representations and the public have the same opportunity to do so

 

NB You only have a prejudicial interest if the matter

 

·        affects your financial position or that of your family, close associate, employer etc or it

·        relates to a regulatory matter

 

 

 

A personal and prejudicial interest should be declared as follows:

 

I have a personal and prejudicial interest in agenda item […] regarding the report on […] because I am […].

 

Advice on this can be sought from staff in Legal and Democratic Services.  Members are requested to seek advice, wherever possible, before the meeting starts.

To consider whether the press and public should be excluded from the meeting during consideration of any item on the agenda.

CALL-IN OF CABINET DECISION - RAVENSFIELD CARE HOME

A valid call-in has been received in respect of a decision taken by Cabinet on 11

November 2010 regarding a report entitled ‘The Future of Ravensfield

Residential Care Home’.

 

The above decision has been called in to examine its merits. The scrutiny

advisory board is asked to:

 

1. Investigate whether appropriate transitional arrangements for respite and dementia care have been put in place

2. Investigate whether the County Council has the power to dispose of the

site, without the receipts being retained within Keswick, as it was gifted to

the precursor of the County Council for specific purposes

3. Consider whether it was appropriate for the Cabinet to make a decision

whilst the debate at Council, as required by the County Council’s petition

scheme, had not taken place.

 

For Panel members’ information, the following papers/documents are enclosed:-

 

(a) the relevant extract from the Constitution on Call ins;

(b) guidance on the suggested procedure to be followed at call-in

meetings;

(c) a copy of the letter requesting the call-in;

(d) a copy of the main report considered by the Cabinet on 11

November 2010 entitled The Future of Ravensfield Residential

Care Home;

(e) the relevant minute extract from the Cabinet meeting held on 11

November 2010;

(f) consultation document on the Proposal to Close Ravensfield

Residential Care Home 28 June – 28 September 2010.

 

The call-in members have also asked for the following additional information:-

 

· the status of the building and site, including the car park;

· the current location in care homes of Keswick residents who were

in Ravensfield and those who were moved into other care homes

over the last year.

 

(g) response from the Corporate Director – Adult and Local Services

on the additional information requested from the call-in members.
