APOLOGIES FOR ABSENCE

Apologies for absence were received from Mr A Connell and Mr D Whipp.

 

20.

DISCLOSURES OF INTEREST

Members are invited to disclose any disclosable pecuniary interest they have in any item on the agenda which comprises

 

1          Details of any employment, office, trade, profession or vocation carried on for profit or gain.

 

2          Details of any payment or provision of any other financial benefit (other than from the authority) made or provided within the relevant period in respect of any expenses incurred by you in carrying out duties as a member, or towards your election expenses.  (This includes any payment or financial benefit from a trade union within the meaning of the Trade Union and Labour Relations (Consolidation) Act 1992.

 

3          Details of any contract which is made between you (or a body in which you have a beneficial interest) and the authority

 

(a)       Under which goods or services are to be provided or works are to be executed; and

 

            (b)       Which has not been fully discharged.

 

4          Details of any beneficial interest in land which is within the area of the authority. 

 

5          Details of any licence (alone or jointly with others) to occupy land in the area of the authority for a month or longer. 

 

6          Details of any tenancy where (to your knowledge)

 

            (a)       The landlord is the authority; and

 

            (b)       The tenant is a body in which you have a beneficial interest.

 

7          Details of any beneficial interest in securities of a body where

 

(a)       That body (to your knowledge) has a place of business or land in the area of the authority; and

 

(b)       Either –

 

(i)      The total nominal value of the securities exceeds £25,000 or one hundredth of the total issued share capital of that body; or

 

(ii)     If that share capital of that body is of more than one class, the total nominal value of the shares of any one class in which the relevant person has a beneficial interest exceeds one hundredth of the total issued share capital of that class.

In addition, you must also disclose other non-pecuniary interests set out in the Code of Conduct where these have not already been registered.

 

Note

 

A “disclosable pecuniary interest” is an interest of a councillor or their partner (which means spouse or civil partner, a person with whom they are living as husband or wife, or a person with whom they are living as if they are civil partners).  

 

Minutes:

Mr W Clark declared an interest in item 6, No 20546 Grasmere Village Society, as he was involved with this group who were applying for this grant and will not take part in the discussions relating to this item.

 

21.

EXCLUSION OF PRESS AND PUBLIC

To consider whether the press and public should be excluded from the meeting during consideration of any item on the agenda.

 

Minutes:

RESOLVED,            that the press and public be excluded from the meeting during consideration of Item No 8– Property Matters as it contains exempt information by virtue of paragraph 3 of Part 1 of Schedule 12A of the Local Government Act 1972.

RESOLVED,            that the minutes of the previous meeting held on 26 January 2018  were agreed as accurate.

CUMBRIA COMMUNITY FOUNDATION AGREEMENT pdf icon PDF 93 KB

The Trustees considered a report from the Corporate Director – Resources and Transformation which identified the unallocated amounts available for distribution on grants and fees for the remainder of the 2017-18 financial year.

 

The Trustees were again disappointed that the Finance Officer could not attend the meeting and asked if he could attend at least one meeting per year and also asked if he could attend the next meeting following the end of the financial year.

 

Following a discussion a question was asked how the figure of £40,000, the amount for distribution in section 4.2 of the report was arrived at. David Rawle, Senior Estates Surveyor mentioned that for as long as he has been attending the Committee meetings it has always been £40,000 and there was no restriction on the sum being reviewed.

 

The Trustees agreed that this should be an item for a future meeting to review this figure.

 

RESOLVED, that

  1. The amount for distribution be reviewed at a future meeting.
  2. Members note the amounts available for distribution on grants and fees for the remainder of the 2017-18 financial year.

The Trustees considered a report which detailed the grant applications received by the Cumbria Community Foundation which included a list of applications and their eligibility criteria. All projects had been assessed on the Community Foundation Standard Procedure.

 

20546 Grasmere Village Society - funding is to improve the facilities in the existing children’s playground. Mr W Clark did not take part in this discussion.

PROPERTY MATTERS

To consider a report from the Land Agent (copy enclosed).

 

Minutes:

The Senior Estates Surveyor and representatives from Savills presented a detailed report which updated the Trustees on current property matters on the Estate, including:-

 

Ø  Leonard Cheshire Disability (LCD) – Holehird House

 

Ø  Lakeland Horticultural Society (LHS)

 

Ø  Holehird Farm Flat

 

Ø  1 North Lodge

 

Ø  Far Orrest Farm – Storm Damage

 

Ø  Farm and Land Rent Reviews

 

Ø  Residential Rent Reviews

 

Ø  General Items.

 

There was a general discussion in respect the tenants of the properties and rents charged and a question was asked if there was any restriction on who the properties are rented to.

 

The Senior Estates Surveyor said that there were no restrictions on who the properties are rented to but there is a preference to have local people/workers in the properties.

 

RESOLVED that:-

 

  1. the Trusts objectives be looked at and possibly revised as they may now be out of date.
