In September 2012 Cabinet signed a Strategic
Planning Agreement (SPA) with Sellafield, the Nuclear
Decommissioning Authority (NDA) and Copeland Borough Council (CBC)
in relation to proposed development activity at the Sellafield
Site. This included a Planning Performance Agreement (PPA), and
gave delegation to negotiate on a Community Benefits Package to
accompany the development projects.
The County Council are being asked to agree a supplemental
agreement which recognises the unique and integral role that
Cumbria County Council and CBC play in the delivery of the
UK’s programme of nuclear decommissioning, clean up and waste
management at Sellafield. It recognises the complexities this
places upon the local authorities in supporting the NDA in
progressing and delivering these complexities at Sellafield.
Cabinet are being asked to agree the final negotiated supplemental
agreement to the SPA and delegate authority to sign this to the
Corporate Director – Environment & Community Services, in
consultation with the Leader and relevant Portfolio Holder.

This is an urgent item because the building of the new school on the Whitehaven Education Campus cannot proceed until all the funding is in place. Cabinet needs to give authority to sign the SPA agreement in order for that element of the funding package to be drawn down.
